"The court finds there is clear and convincing evidence that Mr. Montgomery committed perjury when he signed the September 10, 2007 declaration, and that he signed the declaration in bad faith, vexatiously, wantonly, and for oppressive reasons."
Montgomery et al v eTreppid et al, No. No. 3:06-cv-00056, Order [ECF 985] at 9 (D. Nev. Mar. 31, 2009). The District Court will affirm the sanction as to Montgomery in April 2010.

(This was stated in response to the reporter’s statement that the Obama Justice Department is investigating Arpaio in response to complaints that the MCSO engages in racial profiling.)

Among other things, “Arpaio admitted that he had never read the complaint in the case, was unfamiliar with the details of the allegations of racial profiling therein, didn't know the content of the 14th Amendment to the U.S. Constitution, and had never read the Department of Justice's guidelines concerning the use of race in investigations, which would have applied to his deputies in the field when they were still operating under a 287(g) agreement with ICE.” (Id.)
